Technician alleges employer did not pay overtime

TYLER — A technician is suing a Frisco company, alleging failure to pay proper overtime wages. 

Tyrone Wardle filed a class action lawsuit, individually and on behalf of all others similarly situated July 15 in the Tyler Division for the Eastern District of Texas against HCL America, alleging violation of the Fair Labor Standards Act.

According to the complaint, from October 2014 to the present, Wardle worked for approximately 46 hours per week on certain weeks and was paid approximately $19.50 per hour, but was not paid the extra overtime rate for all hours worked in excess of 40 hours. 

The plaintiff alleges HCL America refused to pay overtime wages and failed to investigate whether its payroll practices were in accordance with the FLSA.

Wardle seeks a trial by jury, double damages for all overtime wages still owed during his entire employment period, attorney fees, court costs, interest and any other relief the court finds reasonable. He is represented by attorney Thomas J. Urquidez of Urquidez Law Firm LLC in Dallas.
