Consumer accuses appliance store of phone harassment

BEAUMONT — A Bridge City woman is suing an appliance store, alleging violation of telephone harassment statutes.

Kimberly Scott filed a lawsuit July 15 in the Beaumont Division of the Eastern District of Texas against Conn Appliances Inc., alleging violation of the Telephone Consumer Protection Act.

According to the complaint, within the last year, Scott began receiving calls to her cellular telephone and has continued to receive automated calls even after she requested Conn Appliances to cease calling her. The suit says the calls caused her to be annoyed, harassed and inconvenienced. 

The plaintiff alleges Conn placed calls using an automatic telephone dialing system and were not for emergency purposes.

Scott seeks a trial by jury, statutory damages of $500 for each negligent violation, treble damages of $1,500 for each determined violation and such other relief as is deemed just and proper. She is represented by attorney Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
