Consumers file suit against debt collector over attempt to collect alleged debt

BEAUMONT – A Delta County couple has filed a suit against a California debt collector alleging it used false, deceptive and misleading statements in an attempt to collect a debt.

Rufus and Jessica Brothers filed a complaint on July 20 in the Beaumont Division of the Eastern District of Texas against Karmen & Michaels Financial Group LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Texas Finance Code.

According to the complaint, the plaintiffs allege that they were contacted by the defendant regarding a purportedly outstanding auto loan. The plaintiffs hold Karmen & Michaels Financial Group LLC responsible because the defendant allegedly used mail, telephone and other means of communications in order to collect a debt and failed to provide meaningful disclosure of its identity and used communication that caused them to believe a lawsuit had been filed against them.

The plaintiffs request a trial by jury and seek to enjoin the defendant from future violations of the law, compensation for damages, attorney's fees and costs and such other and further relief as the court deems just and proper. They are represented by Jeffrey D. Wood of The Wood Firm PLLC in Rockwall.
