The Wellpoint Cos. Inc. alleged to have not paid practice consultant for overtime work

HOUSTON — A practice consultant has filed a class-action lawsuit alleging she is owed unpaid overtime wages.

Teresa Montgomery-Beeston filed a complaint on behalf of all others similarly situated on July 20 in the Houston Division of the Southern District of Texas against The Wellpoint Cos. Inc., formerly known as The Anthem Cos. Inc. doing business as Anthem Inc. and Amerigroup Corp. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she routinely worked for more than 40 hours per week from 2011 to 2015, but was not paid overtime premium for any of the hours regularly worked in excess of 40 hours. The plaintiff holds The Wellpoint Cos. Inc. responsible because the defendant allegedly willfully misclassified her as an exempt employee, paid her on a salaried basis and refused to pay her overtime compensation at a rate of time-and-one-half of her regular rate for all hours worked in excess of 40 in a workweek.

The plaintiff requests a trial by jury and seeks judgment against defendants for unpaid back wages due, costs of this action, attorneys’ fees, pre- and post-judgment interest and such other and further relief as may be necessary.
