Homeowner alleges work wasn't completed or done properly on home

Contract 03

GALVESTON – A Galveston County woman alleges a contractor failed to complete work on her home.

Mercy Griffith filed a complaint on July 21 in the Galveston County District Court against Alejandro “Alex” Silva; Alejandro “Alex” Silva, doing business as DRR Construction; DRR Construction; Alejandro “Alex” Silva, doing business as DRR Construction and Investments LLC; and DRR Construction and Investments LLC alleging fraud, breach of contract and violation of the Texas Deceptive Trade Practices Act.

According to the complaint, the plaintiff hired the defendants to build an addition on her home in August 2015. She alleges the defendants did not finish the project, so she terminated her agreement with the defendants and hired a second contractor to complete the work. The suit states the second contractor reported the defendants' work had been improperly done and had to be redone.

The plaintiff holds the defendants responsible because the defendants allegedly failed to complete the work on time and made false representations about their abilities.

The plaintiff requests a trial by jury and seeks economic damages of $18,343, prejudgment and post-judgment interest, costs of court, legal fees and any such further relief to which she may be entitled in law or in equity. She is represented by R. Talmadge Hammock and Kristin F. Munkittrick of Hammock Law Firm in Houston.
