Tractor-trailer driver accused of negligence after I-20 accident

BEAUMONT – A transportation company and its driver are facing a suit after an accident on Interstate 20 in Smith County.

Warren Keith Hollister and Russell Bradley filed a complaint on July 22 in the U.S. District Court for the Eastern District of Texas against Verdel McCant, Rainwater Leasing LTD, Total Highway Maintenance LLC and Liberty Mutual Fire Insurance Co. alleging negligence.

According to the complaint, on July 25, 2015, Hollister was driving a 2015 Dodge Ram 3500 in the left lane of westbound Interstate 20 in Smith County. McCant was operating a tractor-trailer owned by defendant Rainwater and traveling in the opposite lane, the suit states, when suddenly and without warning, he lost control of his vehicle and crashed into plaintiff's vehicle. Hollister was pulling a trailer owned by Bradley at the time of the incident, and it was allegedly damaged.

The plaintiff holds Verdel McCant, Rainwater Leasing LTD, Total Highway Maintenance LLC and Liberty Mutual Fire Insurance Co. responsible because McCant allegedly operated the vehicle carelessly and recklessly and failed to stay in his lane of travel.

The plaintiff requests a trial by jury and seeks judgment against defendants in a sum sufficient to reasonably compensate plaintiffs' damages, and for all costs of these proceedings and for all other general and equitable relief.
