Construction worker alleges ex-employer failed to pay proper wages

HOUSTON — A Houston man is suing a Texas business, alleging failure to pay correct wages.

Erick Marvel filed a class action lawsuit, individually and on behalf of all others similarly situated, July 25 in the Houston Division of the Southern District of Texas against Herc Solutions USA LLC, alleging his former employer violated the Fair Labor Standards Act.

According to the complaint, during Marvel's employment from January through February 2016 as a construction worker putting up and cutting pipes, he was not paid the promised regular wage per hour and was not paid an overtime premium. 

The plaintiff alleges Herc Solutions failed to pay the statutory overtime compensation for all hours worked of more than of 40 hours per week as required by FLSA. 

Marvel seeks a trial by jury, unpaid wages with an equal amount of liquidated damages, attorney fees and legal costs, post-judgment interest and all other equitable or injunctive relief. He is represented by attorney Taft L. Foley II of The Foley Law Firm in Houston.
