Customer blames Wal-Mart for parking lot injury

SHERMAN — A Texas customer is suing Wal-Mart, alleging its negligence caused her to suffer injuries in a parking lot owned by the defendants.

Donah Lamb filed a lawsuit July 27 in the Sherman Division of the Eastern District of Texas against Wal-Mart Stores Texas LLC, alleging negligence in failing to provide ordinary care to protect the plaintiff.

According to the complaint, on Nov. 25, 2015, while Lamb was walking in a Wal-Mart parking lotat 3855 Lamar St., Paris, Texas, a line of shopping cart being pushed by defendant's employee struck her from behind. The suit says Lamb sustained injuries and pain and suffering. As a result, the lawsuit states, she incurred necessary medical expenses. 

The plaintiff alleges the defendant negligently allowed its employee to push a line of shopping carts without assistance, failed to warn Lamb  of the dangerous condition and failed to adequately train employees to properly manage their premises.

Lamb seeks trial by jury, compensation for medical care and treatment in a reasonable amount of $100,000, for physical pain and mental anguish not to exceed $250,000, for loss wages in the amount not to exceed $150,000, legal costs and pre- and post-judgment interest. She is represented by attorney Scot G. Dollinger of Dollinger Law in Houston.
