Mother blames husband's traffic death on tavern owner

BEAUMONT — A mother and two children are suing a tavern owner, alleging unlawful sale of liquor to an intoxicated person.

Christiana Franklin, as natural guardians of minor Aspein Reigh Lakey and Hadleigh Brooke Lakey, filed a lawsuit July 19 in Jefferson County District Court against The entertainment LLC, doing business as Crazy 8's, alleging violation of the Dram Shop Act in Alcohol Beverage.

According to the complaint, on Nov. 15-16, 2014, Justin Douglas Lakey was involved in a vehicle accident that caused his death and that of a passenger. Toxicology results of Lakey found a BAC of .230, nearly three times the legal limit, the suit says. 

The plaintiffs allege loss of companionship and society, mental anguish and loss of consortium. The plaintiffs allege Crazy 8's employees provided alcoholic beverage to Justin Douglas Lakey, who was obviously intoxicated to the extent that he presented a clear damage to himself and to others.

Franklin and her children seek trial by jury, monetary relief of more than $1 million, costs of court, pre- and post-judgment interest, and all other equitable relief. They are represented by attorneys Michael R. Ramsey and Katherine D. Ramsey of Ramsey Law Firm in Beaumont, by Chadwick G. Robinson of Orange, and by Tommy Gunn of Orange.
