Three workers accuse former employers of not paying overtime

HOUSTON — Three employees are suing their former employers, alleging failure to pay federally mandated overtime. 

David Elias, Jawan Moore and Erik Rodriguez filed a class action lawsuit, individually and on behalf of all other similarly situated persons, July 28 in the Houston Division of the Southern District of Texas against ICare Dealer Services, Inc., Mohammed Jamal Alaqui, IVP Dealership Services LLC and Issam Bourhane Eddine, alleging violations of the Fair Labor Standards Act.

According to the complaint, Elias, Moore and Rodriguez regularly worked more than 60 hours per week without being paid overtime premium for weekly hours worked in excess of 40. The plaintiffs allege the defendants willfully disregarded their federally protected rights by not properly compensating them at time and a half for the extra work performed.

The plaintiffs seek trial by jury, judgment equal to their unpaid overtime wages, liquidated damages, all legal costs and attorney fees, plus all relief the court deems just and equitable. They are represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of The Buenker Law Firm in Houston.
