Texas woman accuses appliance store of phone harassment

HOUSTON — A Webster woman is suing an appliance store, alleging the defendant continues to harass her with phone calls.

Lillith St. Mary filed a lawsuit Aug. 1 in the Houston Division of the Southern District of Texas against Conn Appliances Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, during the past year, St. Mary has received calls to her cellular telephone from Conn Appliances. The suit says she has incurred charges for incoming calls and was annoyed, harassed and inconvenienced by the defendant’s continued calls. 

The plaintiff alleges Conn Appliances made calls using an automatic telephone dialing system and a prerecorded or artificial voice and continues to place automated calls despite knowing it lacked the consent to do so.

St. Mary seeks a trial by jury, an award of $500 for each negligent violation, up to $1,500 for each willful violation and all relief the court deems proper. She is represented by attorney Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
