Texas couple accuses multiple entities of breach of contract

HOUSTON — A Harris County couple is suing multiple entities, alleging fraud and breach of contract.

Lantana Lavine and Kevin Lavine filed a lawsuit Aug. 3 in Galveston County District Court against Pillar Insurance Company, Wellington Claim Service Inc., Wellington Risk Insurance Ageny Inc., Kolby Thornton, Glenda Alvarez and Darielle Thompson, alleging violation of the Texas Insurance Code.

According to the complaint, the roof of the Lavines' house in Spring sustained extensive damage during a storm. The suit says there was additional structural and exterior damage throughout the entire home during a second storm. 

The lawsuit states the Lavines submitted a claim for all damages to their property, but the claim was improperly adjusted and grossly underpaid. The plaintiffs allege the defendants failed to perform a thorough inspection, failed to provide full coverage and denied adequate and sufficient payment to repair their home without performing reasonable investigation.

The Lavines seeks a trial by jury, compensation between $200,000 and $1 million, attorney fees, costs of court, pre- and post-judgment interest and all relief to which are justly entitled. They are represented by attorneys Amber Anderson Mostyn and Molly K. Bowen of Mostyn Law in Houston.
