Mother blames former caretaker for baby son's injuries.

HOUSTON — A Harris County mother is suing a former caretaker, alleging the defendant's negligence contributed to her son's injuries. 

Andrea Trevino, individually and as next friend of Carlos Temores, a minor, filed a lawsuit Aug. 3 in Harris County District Court against Stacy Richelle Hart-Ellis, alleging negligence in failing to protect her child.

According to the complaint, on March 29, 2009, Trevino entrusted her 15-month-old son, Carlos Temores to Hart-Ellis. Later that day, the suit says, the defendant contacted Trevino and explained Temores had fallen off the sofa and appeared to be injured. 

After medical examination, the lawsuit states, it was concluded Carlos Temores suffered a broken leg. As a result, the complaint says, Trevino sustained pecuniary losses and mental anguish, plus lost wages and medical expenses. 

The plaintiff alleges Hart-Ellis failed to provide appropriate care, custody and supervision toward Temores and negligently allowed him to fall off the sofa.

Trevino seeks a trial by jury, damages, costs of court, pre- and post-judgment interest, and all relief to which she is justly entitled. She is represented by attorney Krystin Collins of Chmielowiec & Associates in Houston.
