Employee alleges construction company failed to pay overtime

HOUSTON — A Texas man is suing a construction company, alleging failure to pay overtime.

Salvador Solorzano filed a class action lawsuit, individually and on behalf of all persons similarly situated, Aug. 4 in the Houston Division of the Southern District of Texas against Ramirez & Son Construction LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Solorzano frequently worked more than 40 hours per week without receiving overtime premium. The plaintiff alleges Ramirez & Son failed to compensate Solorzano at a rate of no less than one and one-half times his regular rate for each hour worked more than 40 per week as required by FLSA.

Solorzano seeks trial by jury, an order permitting this litigation to proceed as a class action, compensation for damages, pre- and post-judgment interest, litigation costs, expenses, attorney fees and all relief the court deems proper. He is represented by attorneys Jeremy D. Saenz and Jason Wagner of Wagner Saenz Dority LLP in Houston.
