Car dealer alleges ex-employee, competitor took proprietary information

HOUSTON — A Houston car dealer is suing a former employee and a Katy competitor, alleging breach of a confidential relationship.

Joe Myers Ford II LLC, doing business as Joe Myers Ford - Lincoln, filed a lawsuit Aug. 5 in Harris County District Court against Mark Joseph Harris and Texan Ford Inc, doing business as AutoNation Ford Katy, alleging breach of contract and misappropriation of information.

According to the complaint, Joe Myers Ford suffered irreparable financial harm and severe damages by loss of a competitive advantage. The plaintiff alleges Harris violated his contractual and fiduciary obligations when he misappropriated confidential and proprietary customer information and that AutoNation benefited from this confidential information.

Joe Myers Ford seeks a trial by jury, an order for the defendants to account for and return all data taken from the plaintiff, a temporary restraining order, actual and exemplary damages, legal costs, attorney fees, pre- and post-judgment interest and all other relief the court deems just and proper. He is represented by attorneys Holly H. Williamson and Michael Reed of Hunton & Williams LLP in Houston.
