Air condition technician alleges former employers failed to pay overtime

TYLER — An HVAC service technician is suing his former employers, alleging failure to pay proper overtime. 

Michael Wester filed a lawsuit Aug. 8 in the Tyler Division of the Eastern District of Texas against Lightfoot Air Conditioning & Refrigeration Inc. and Alfred I. Lightfoot, alleging violation of the Fair Labor Standards Act.

According to the complaint, during Wester's employment from May 2012, to August 2015, he was not properly compensated for all his hours worked and was not paid overtime compensation at the rate of time and one half of his regular rate of pay. 

The plaintiff alleges the defendants failed to pay overtime wages for his work of more than 40 hours per week, as required by FLSA.

Wester seeks trial by jury, unpaid back wages, liquidated damages, court costs, attorney fees, pre- and post-judgment interest and all other relief to which he is justly entitled. He is represented by attorneys Robert (Bobby) Lee, Meagan Whitley and Megan Dixon of Lee & Braziel LLP in Dallas.
