Texas City homeowner alleges contractors owe more than $100,000

GALVESTON — A Texas City woman is suing contractors and a subcontractor, alleging they owe at least $100,000 for breach of contract.

Rose Mary Peavey filed a lawsuit Aug. 10 in Galveston County District Court against Blu Shields Construction LLC, Arnold Shields, M&E Marble and Glass Inc. and Jorge A. Garcia, alleging violation of the Deceptive Trade Practices Act.

According to the complaint, on April 8,Peavey entered into a contract with the defendants for the purchase of goods and services for the remodeling of her home at 1925 16th Ave. N. Texas City. The house was not finished on time, the suit says and within the budget, causing her to suffer financial loss, plus the of use and value of the property, cost of repair, and loss of sale of the property. 

The plaintiff alleges the defendants abandoned the house unfinished June 20, and failed to provide a list of the subcontractors and improperly filed liens related to the construction contract.

Peavey seeks trial by jury, monetary relief between $100,000 and $200,000, a temporary restraining order, permanent injunction, actual damages, pre- and post judgment interest, court costs, attorney fees and all relief to which she is entitled. She is represented by attorneys Robert D. Clements, Jr. and Patrick "Pat" Huzinec of Law Offices of Robert D. Clements Jr. and Associates in Alvin.
