Diligent Delivery Systems dismissed from overtime suit

HOUSTON – A Harris County man who alleged he was not paid overtime wages while employed as an account manager has dismissed his claims against the defendant.

Angel Meza filed a complaint on behalf of all others similarly situated employees and former employees of defendants on May 24 in the Houston Division of the Southern District of Texas against Diligent Health LLC and Diligent Acquisitions LLC, both doing business as Diligent Delivery Systems alleging violation of the Fair Labor Standards Act.

Court records show Meza filed a notice of dismissal in the case and on Aug. 9 an order of dismissal with prejudice was subsequently entered.

According to the complaint, the plaintiff alleged that between July 7, 2014, and Nov. 1, 2015, he worked for more than 40 hours but did not receive any overtime compensation.

The plaintiff held Diligent Health LLC and Diligent Acquisitions LLC responsible because the defendants allegedly failed to pay a rate of time-and-one-half to their employees working for more than 40 hours at a given work week.

The plaintiff was represented by G. Scott Fiddler of Fiddler & Associates PC in Houston.

The defendant was represented by Maurice Bresenhan Jr., attorney for the Houston law firm Zukowski, Bresenhan & Piazza.
