Contractor alleges Montgomery residents broke copyright law

HOUSTON — A Spring contractor is suing two Montgomery residents, alleging breach of construction agreement and design service contract.

Design Tech Homes Ltd. filed a lawsuit Aug. 18 in U.S. District Court for the Southern District of Texas against Maria Araceli Jasso and Larry N. Rogers, alleging violation of the Federal Copyright Act.

According to the complaint, on Dec. 6, 2014, Design Tech Homes and and defendants executed a construction agreement for the construction of the plaintiff's model described as "Jasso Plan" at 5840 Hornea Egypt Road in Montgomery. As a result of the defendants actions, the suit says, Design Tech Homes has suffered financial damages and loss of profit. 

The plaintiff alleges the defendants produced an architectural plan named as the "Rogers Plan," and, except for an addition of the exercise room and an office, it is substantially similar to the "Jasso Plan," thereby violating the plaintiff's copyright.

Design Tech Homes seeks trial by jury, judgment of $150,000, pre- and post-judgment interest, attorney fees and court costs and all other relief. It is represented by attorney John R. Krugh of Houston.
