Three technicians allege oil drilling company failed to pay overtime

HOUSTON — Three Pennsylvania technicians are suing a Houston oil drilling company, alleging failure to pay overtime. 

Trent Bertothy, Brandon Burge and Tyler McCully filed a lawsuit Aug. 19 in the Houston Division of the Southern District of Texas against Aly Centrifuge Inc., also known as AlyCentrifuge, alleging violation of the Fair Labor Standards Act.

According to the complaint, Bertothy, Burge and McCully regularly worked more than 40 hours per week but were only paid a flat rate for the days they worked and did not receive overtime pay. 

The plaintiffs allege Aly Centrifuge classified them as exempt from overtime requirements and failed to pay the overtime rate of one-and-one-half times their regular rates for all hours worked more than 40 per week as required by FLSA.

The plaintiffs seek trial by jury, all unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all relief as is necessary. They are represented by attorneys Adam Poncio of Poncio Law Offices in San Antonio, and by Chris McJunkin of Corpus Christi.
