Customer blames retail store operator for injuries

HOUSTON — A Harris County woman is suing a retail store operator, alleging its negligence caused her to fall and sustain injuries. 

Betty Conde filed a lawsuit Aug. 29 in Harris County District Court against HEB Grocery Company LP, alleging negligence in failing to maintain its property in a reasonably safe condition.

According to the complaint, on June 18, Conde was shopping with her son at the HEB grocery store in Humble. As she was in the produce area near the fresh berry display, the suit says, Conde slipped and fell on berries that were on the floor. 

The lawsuit states Conde suffered injuries, leading to pain, mental anguish, medical expenses and lost wages. The plaintiff alleges HEB Grocery failed to eliminate the dangerous condition and failed to warn Conde of such a danger.

Conde seeks trial by jury, all damages, plus court costs and expenses, pre- and post-judgment interest and all other relief to which she is entitled. She is represented by attorney Hilda L. Sibrian of The Law Office of Hilda L. Sibrian PC in Houston.
