Music media provider accuses competitor of defamatory acts

MARSHALL — A Pennsylvania music business is suing a North Carolina competitor, alleging illegal business practices.

Stingray Music USA Inc. of Horsham, Pennsylvania, filed a lawsuit Aug. 30, in the Marshall Division of the Eastern District of Texas against Music Choice of Charlotte, North Carolina, alleging defamatory acts by making false statements about the plaintiff's products and services.

According to the complaint, Stingray Music suffered irreparable damage to its brand name, reputation and good will and was caused to lose its customers, make concessions in its contracts with customers, expend significant manpower and money and other non-monetary losses. The suit says Music Choice intentionally and unlawfully engaged in a smear campaign against the plaintiff and made false misrepresentations of fact regarding its products and services.

Stingray Music seeks trial by jury, an order permanently enjoining Music Choice from engaging in any of the unlawful, unfair and fraudulent business acts and practices, all damages, interest, attorney fees, court costs and disbursements and all other relief permitted by law.
