Houston couple alleges contractors owe $1 million for botched home project

HOUSTON — Two homeowners are suing Houston contractors, alleging the defendants owe more than $1 million for fraud. 

Mike and Alexandria Feagin of Houston filed a lawsuit Sept. 2 in Harris County District Court against South Wall Builders Inc., doing business as Rockwell Homes, and Michael G. Evanson, alleging breaching their contractual duty to provide a warranty and failure to build a suitable home.

According to the complaint, on June 7, 2012, Mike and Alexandria Feagin entered into a residential sale and construction contract with defendants to build their home at 3302 Suffolk Drive, Houston, for a total price of $1,054,640. Upon taking their home, the suit says, the plaintiffs began to notice issues arising from poor construction that pose significant safety hazard. 

The lawsuit states the defendants represented their work as complete, which is was not, and of good quality, which it also was not.

The plaintiffs allege the defendants failed to provide a safe dwelling place, failed to provide the agreed warranty and failed to construct the home in a good and workmanlike manner.

The Feagins seek trial by jury, monetary relief of more than $1 million, plus attorney fees and court costs. They are represented by attorneys Jason Ostrom and Kenneth A. Scott of Ostrom Morris PLLC in Houston.
