Drill pipe supplier alleges North Dakota business owes money

HOUSTON — A Houston drill pipe supplier is suing a North Dakota business, alleging breach of contract.

Vallourec Drilling Products USA Inc. filed a lawsuit Aug. 31 in the Houston Division of the Southern District of Texas against B.J.’s Drill Stem Testing, Inc. doing business as Drill Tech LLC of Mohall, North Dakota, alleging failure to perform its contractual obligations.

According to the complaint, in May 2014, Vallourec Drilling sold and delivered to Drill Tech defendant 620 joints of 4-inch drill pipe and 60 joints of 4-inch heavyweight drill pipe for a sales price of $1,282,748.40. To date, it has not receive full payment for the remaining balance, the suit says. 

The plaintiff alleges Drill Tech took physical possession of the drill pipes and failed to make any additional payments after it paid the 30 percent non-refundable deposit of $384,824.52.

Vallourec Drilling Products seeks trial by jury, payments for all amounts due, plus attorney fees, court costs and expenses, pre- and post-judgment interest and any other relief to which its is entitled. It is represented by attorneys Jeffrey Burbach and Chevazz G. Brown of Jackson Walker LLC in Houston.
