BEAUMONT — A Jefferson County mother and minor children are suing a demolition service provider, alleging the defendant's negligence caused the death of the plaintiff's husband and father.
Juana Ayala, individually and as representative of the estate of Ramiro Ayala and as next friend of J.A., a minor, J.A., a minor, N.A., a minor and M.A., a minor, filed a lawsuit Sept. 1, in the Jefferson County District Court against Environmental Remediation Services Inc. alleging that the demolition service provider breached its duty to provide a safe place to work.
According to the complaint, on Aug. 30, 2016, Ramiro Ayala was working on a rig owned by defendant, the Sovereign Explorer. While standing on the rig, the suit says, the part of the rig Ayala was standing on broke free and he fell to his death.
The lawsuit states the plaintiffs suffered loss of economic support, grief, mental anguish, medical expenses and funeral expenses. The plaintiffs allege the defendant failed to provide trained employees and failed to provide safe equipment.
The plaintiffs request a trial by jury and seek monetary relief of more than $1 million, plus court costs, pre- and post-judgment interest and all other relief. They are represented by attorneys Cade Bernsen, David E. Bernsen and Christine L. Stetson of The Bernsen Law Firm in Beaumont.
