Coffee products distributor accuses competitor of deceptive trade practices

HOUSTON — A Houston coffee brewing products distributor is suing a California competitor, alleging unfair competition, trademark infringement and deceptive trade practices.

Solofill LLC filed a lawsuit Sept. 6 in the Houston Division of the Southern District of Texas against Adrian Rivera and ARM Enterprises Inc. of La Miranda, California, alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, Solofill has suffered irreparable harm to its good will, logo and trade dress and reputation for innovation and quality because of the actions of Rivera and ARM. The suit says Solofill will also suffer great and irreparable loss by the diversion of its customers. 

The plaintiff alleges the defendants used a confusingly similar trademark, Eco-fill, a confusingly similar logo and a confusingly similar trade dress, creating confusion and deception to the members of the trade, consumers and the public.

Solofill seeks trial by jury, declaration the defendants’ coffee brewing products are counterfeit, that the defendant's conduct comprises unfair competition and unjust enrichment, and permanently enjoining defendants from infringing the plaintiff’s trademark. It is represented by attorney Sandeep Seth of Sethlaw in Houston.
