Tyler worker accuses Lindale furniture business of failure to pay overtime

TYLER, Texas  — A Smith County man is suing a Texas furniture business, alleging violation of workers compensation acts in failing to pay overtime.

Jose Oliveros of Tyler filed a class action complaint, individually on behalf of all others similarly situated, Sept. 7 in U.S. District Court for the Eastern District of Texas Tyler Division against Manual Valdiva, doing business as Kayla’s Furniture, alleging violation of the Labor Standards Act.

According to the complaint, Oliveros worked between 60 and 70 hours per week but was not paid overtime wages. The plaintiff alleges Kayla’s Furniture failed to pay proper overtime compensation a rate of one and one-half times his hourly rate for all hours worked more than 40 a week as required by FLSA.

Oliveros seeks trial by jury, unpaid wages due, plus liquidated damages, court costs, attorney fees and all other the court deems just. He is represented by attorney William S. Hommel Jr. of Hommel Law Firm in Tyler.
