Minor child blames GM for injuries

LUFKIN — A minor child is suing General Motors, alleging the defendant's negligence caused injuries to the plaintiff. 

K.L., a minor child, from San Augustine by and through her next friends, Donathan Lane and Pamela Jenkins filed a lawsuit Sept. 7 in the Lufkin Division of the Eastern District of Texas against General Motors LLC, alleging failure to provide a crashworthy vehicle.

According to the complaint, on April 23, K.L. was properly seated and properly wearing the available seat belt when a 2009 Chevrolet C1500 he was in riding struck a westbound vehicle, causing it to skid and strike a road sign. Despite properly wearing the available seat belt, the suit says, the minor child sustained serious injuries that caused her to endure pain and suffering, impairment and disfigurement and extensive medical expenses. The plaintiff alleges General Motors failed to provide proper restraint, failed to contain ejection mitigation glass and failed to contain side curtain airbags.

The plaintiffs seek trial by jury, actual damages, pre- and post-judgment interest, costs of suit and all other relief. They are represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
