Eight workers accuse wireless company of failing to pay overtime

HOUSTON — Eight employees are suing a Houston wireless company, alleging violation of workers compensation acts in failing to pay overtime wages.

Felicia Hendrix, Cynthia Brown, Omar Mohammad, Carum Rogers, John Eberle, Doug Shipe, Brian Quinn and Michelle Yarborough filed a class action lawsuit, individually and on behalf of all others similarly situated, Sept. 7 in the Houston Division of the Southern District of Texas against Shipcom Wireless Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the eight plaintiffs all worked more than 40 hours per week during most work weeks but were not paid overtime compensation for each hour worked in excess of 40 per week. The plaintiffs allege Shipcom Wireless Inc. violated FLSA by not paying time and half for each hour worked more than 40 per week. 

The plaintiffs seek trial by jury, an order allowing this suit to proceed as a collective action, unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, post-judgment interest and all other relief. They are represented by attorneys Mark G. Lazarz and Daryl J. Sinkule of Shellist Lazarz Slobin LLP in Houston.
