Employee blames Lowe's Home Center for injuries

GALVESTON — A Lake Jackson man is suing Lowe's Home Center, alleging Lowe's negligence led to the plaintiff suffering injuries. 

Alfred Aguirre filed a lawsuit Sept. 12 in the Galveston Division of the Southern District of Texas against Lowe's Home Center LLC, alleging violation of the Texas Workers' Compensation Act and the Texas Labor Code.

According to the complaint, on Aug. 25, 2015, Aguiree injured his left shoulder while helping a co-worker lower a box from an upper shelf at the Lowe's store in Lake Jackson. The suit says as a result of Lowe's non-subscription to a workers' compensation plan, Aguirre sustained medical expenses and mental anguish. 

The plaintiff alleges Lowe's failed to properly supervise its employees, failed to provide adequate safety equipment and disregarded the dangers included in the manual maneuvering of a heavy box from a top shelf height.

Aguirre seeks trial by jury, judgment in excess of the minimum jurisdictional limits of the court, pre- and post-judgment interest, costs of court and all other relief to which he is justly entitled.
