Customer alleges home security system provider violated law

GALVESTON — A Galveston County man is suing a home security system provider, alleging negligent misrepresentation.

Craig Alan Doss filed a lawsuit Sept. 12 in Galveston County District Court against Vivint Inc., alleging violation of the Texas Fair Debt Collection Act.

According to the complaint, in June 2014, prior to entering into a contract, Vivint advised Doss that if he moved during the term of the contract, it would install the home security system for only $99. The suit says when Doss notified Vivint of the move, the defendant demanded that Doss return the equipment or pay a $899 fee.

The lawsuit says Vivint's actions caused Doss damages, including loss of credit rating and loss of access to lending. The plaintiff alleges Vivint negligently supervised its agents who made the false representation.

Doss seeks trial by jury, judgment against Vivint in the amount shown by the evidence, plus damages, pre- and post-judgment interest, attorney fees and court costs and all other relief. He is represented by attorneys John V. Mastriani and Christopher M. Thornhill of The Mastriani Law Firm in Houston.
