Supervisor alleges former employer failed to pay overtime

HOUSTON — A Harris County man is suing his former employer, alleging failure to pay overtime in violation of workers compensation acts.

Jorge Tobar filed a lawsuit Sept. 14 in the Houston Division of the Southern District of Texas against Brown Integrity LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Tobar, who supervised employees assembling and operating equipment, was not paid an overtime premium for all hours worked more than 40 in a week. The plaintiff alleges Brown Integrity failed to pay proper overtime compensation at a rate of one and one-half times his regular rate for all hours worked more than 40 per week as required by FLSA.

Tobar seeks trial by jury, unpaid overtime wages, liquidated damages, prejudgment interest, court costs and attorney fees, plus all further relief. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Buenker Law in Houston.
