HOUSTON — Five courier and delivery drivers are suing their employers, alleging failure to pay proper overtime wages.
have filed a class-action lawsuit against E & L Transfer, LLC, Edward J. Tweed and Veritas Personnel Service, Inc., employers, citing alleged violation of workers compensation acts.
Kent Brown, Colin Graff, Yolanda Hannibal, Eric Lindquist and Nestor Mendoza filed a class action complaint, individually and on behalf of all similarly situated persons Sept. 14 in the Houston Division of the Southern District of Texas against E & L Transfer, LLC, Edward J. Tweed and Veritas Personnel Service Inc., alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiffs regularly worked more than 40 hours a week throughout their employment with the defendants but were not paid any overtime premium for hours worked more than 40 per week. The plaintiffs allege the defendants failed to properly compensate them for their overtime work at a rate of 1 1/2 times regular play as required by FLSA..
The plaintiffs seek trial by jury, judgment against the defendants equal to their unpaid overtime wages, liquidated damages, prejudgment interest, attorney fees and all such further relief. They are represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of The Buenker Law Firm in Houston.
