Lyondellbasell hit with $1M injury suit

Harris County resident accuses property possessor of failure to warn

HOUSTON — An invitee is suing Equistar Chemicals LP and Lyondellbasell, property possessors, citing alleged insufficient measures were taken to prevent injuries.

Trivia S. Smith filed a complaint on Sept. 12, in the Harris County District Court against the defendants alleging that they breached their duty of ordinary care in maintaining their premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that, in March 2, 2015, she entered defendants premises to make a delivery when she was seriously injured when she tripped and fell due to uneven walkway. Her injuries caused her to suffer physical pain, mental anguish and disfigurement. The plaintiff holds Equistar Chemicals LP and Lyondellbasell responsible because defendants employee allegedly created an unreasonable dangerous condition, negligently allowed the walkway to become uneven and failed to warn plaintiff of the dangerous condition.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not less than $1,000,000, plus court costs, pre- and post-judgment interest and such other and further relief. She is represented by James M. Lassiter, III of Lassiter Law Firm in Houston.
