Customer blames Lowe's Home Centers for injuries

GALVESTON — A Texas woman is suing Lowe's Home Centers, alleging its negligence caused her to be exposed to toxic chemicals. 

Karen Kuykendall filed a lawsuit Sept. 14 in Galveston County District Court against Lowe's Home Centers LLC,  alleging negligence in failing to exercise ordinary care to keep its premises in a reasonably safe condition.

According to the complaint, on April 15, 2015, she was shopping at the Lowe's store in Kingwood when boxes of containers of liquid insecticide fell into the aisle immediately beside her. Upon hitting the floor, the suit says, a container burst open, drenching Kuykendall with toxic chemicals, causing her to be exposed to the pesticide’s hazardous contents.

The lawsuit states this resulted in serious and permanent injuries to Kuykendall. The plaintiff alleges Lowe's Home Centers failed to properly secure the boxes in the top shelf and failed to provide adequate warnings of any defects.

Kuykendall seeks trial by jury, judgment within the jurisdiction of the court for actual and exemplary damages, pre- and post-judgment interest, costs of suit, and all other relief.
