GALVESTON — A Galveston County woman is suing a Dickinson motorist, alleging the defendant's negligence led to the death of the plaintiff's husband.
Melissa Young filed a complaint on Sept. 21, in the Galveston County District Court against Desierre Nicole Garcia alleging wrongful death that the motorist breach her duty to exercise due care to protect other persons and properties on the road.
According to the complaint, on July 2, the plaintiff's spouse, Roderick Terril Young Sr., died when his vehicle was smashed into by Garcia's car. The suit says Garcia, driving a 2012 Dodge Challenger, and made an illegal left turn onto state Highway 3 in La Marque.
The lawsuit states Melissa Young has suffered pecuniary losses, mental anguish, loss of companionship and society and loss of inheritance. The plaintiff alleges Garcia negligently drove her vehicle while operating a mobile telephone, failed to yield right of way and turned left on a solid green light, not a green arrow.
Young seeks trial by jury, monetary relief of more than $1 million, court costs, attorney fees and all other relief. She is represented by attorney Eric J. Kirkpatrick of Kirkpatrick Law Office PC in Houston.
