Homeowner alleges Insgroup misrepresented insurance policy's coverage

HOUSTON – A Harris County homeowner alleges that an insurance agency misrepresented her policy's coverage.

Humaira Keller filed a complaint on Sept. 23 in the Harris County District Court against Insgroup Inc. alleging violation of the Texas Insurance Code and negligence.

According to the complaint, the plaintiff alleges that she is a client of the defendant and purchased a homeowner's insurance policy in 2006, which she was told included coverage for foundation and water damage, through Travelers Lloyds of Texas Insurance Co. In June 2014, she contacted Travelers regarding water damage to her foundation and was told her policy did not have the endorsement.

The plaintiff holds Insgroup Inc. responsible because the defendant allegedly represented that the Travelers Lloyds of Texas Insurance policy included coverage for her home's foundation and water damage and failed to procure coverage for foundation and water damage.

The plaintiff requests a trial by jury and seeks judgment against defendant for monetary relief of over $200,000 but not more than $1 million, award for mental anguish damages, attorney's fees, expenses and cost and for such other relief. She is represented by Millard A. Johnson and Sara J. Sherman of Johnson Deluca Kurisky & Gould in Houston.
