Assistant maintenance worker alleges former employer failed to pay overtime

HOUSTON — A Harris County man is suing his former employer, alleging violation of workers compensation acts in failing to pay overtime.

Jose Israel Diaz filed a lawsuit Sept. 23 in the Houston Division of the Southern District of Texas against Community Management LLC, doing business as Villas at Cypresswood, alleging violation of the Fair Labor Standards Act.

According to the complaint, Diaz, an assistance maintenance worker, was paid a fixed weekly salary regardless of the number hours he worked and was not paid one and one-half times his regular hourly rate for hours worked in excess of 40 per week. 

The plaintiff alleges the defendant failed to properly compensate him for all hours worked in excess of 40 hours per week as required by FLSA.

Diaz seeks trial by jury, the full amount of all unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, pre and post-judgment interest and all other relief. He is represented by attorneys Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
