John Deere alleges Kemah customer owes $84,000

GALVESTON — John Deere is suing a Kemah man, alleging breach of contract in failure to pay more than $84,000.

John Deere Construction & Forestry Company filed a lawsuit Sept. 26 in Galveston County District Court against Jonathan Ashley Dittman alleging failure to comply with their security agreement.

According to the complaint, in the course of its business, John Deere advanced funds to Dittman pursuant to a loan contract. After all just and lawful offsets, credits and payments, the suit says, the amount of $84,762.04 remains unpaid to John Deere. 

The plaintiff alleges Dittman executed a security agreement granting security interest and failed to make the required payment.

John Deere Construction and Forestry seeks trial by jury, judgment for $84,762.04, plus interest, attorney fees of $3,500, all costs of court and all other relief. It is represented by attorney Jody D. Jenkins of Jenkins, Wagnon & Young PC in Lubbock.
