Maintenance worker alleges pet cemetery failed to pay overtime

SHERMAN — A Denton County man is suing an Aubrey pet cemetery, alleging violation of workers compensation acts in failing to pay overtime.

Michael Lozano filed a lawsuit Sept. 26 in the Sherman Division of the Eastern District of Texas against Pet Haven Memorial Park Inc., Colette Olivieri and John Doe 1-5, alleging violation of the Fair Labor Standards Act.

According to the complaint, Lozana regularly worked more than 40 hours per week in maintenance but was paid a fixed salary with no overtime compensation for hours worked in excess of 40 in a week. 

The plaintiff alleges the defendants failed to pay time and one-half his regular rate of pay for each hour worked more than 40 in a week as required by FLSA.

Lozano seeks trial by jury, actual damages, liquidated damages, post-judgment interest, court costs, attorney fees and all other relief. He is represented by attorney Roger D. Marshall of Dallas.
