BEAUMONT – A railroad worker alleges he injured his back while on the job.

Louis Matthew Farrow filed a complaint on Sept. 23 in the Jefferson County District Court against The Kansas City Southern Railway Co. alleging that the common carrier violated the Safety Appliance Act and negligence.

According to the complaint, the plaintiff alleges that on Aug. 3, he was working for defendant when he was severely injured while shoveling coke from a derailed car. He alleges the incident caused him to suffer pain and mental anguish, disfigurement, loss of earning capacity, and medical expenses.

The plaintiff holds The Kansas City Southern Railway Co. responsible because the defendant allegedly failed to provide a safe place to work, failed to provide safe and suitable equipment and failed to provide adequate manpower.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount within the jurisdictional limits of the court, pre- and post-judgment interest, costs of suit and such other and further relief. He is represented by Bristol Baxley of Rome, Arata & Baxley LLC in Pearland.
