MARSHALL — A Longview couple is suing a bottled water supplier, alleging the defendant's negligence led to a vehicle crash that injured the plaintiffs.
Candace Phelan and Kevin Phelan filed a lawsuit Sept. 29 in the Marshall Division of the Eastern District of Texas against Music Mountain Water Co. LLC, alleging the defendant negligently entrusted a delivery vehicle to a reckless employee.
According to the complaint, on Nov. 21, 2014, the Phelans sustained bodily injuries when a Music Mountain Water vehicle driven by its employee collided with the Phelans' vehicle. They suit says the Phelans suffered severe physical and mental pain and loss of consortium, plus expenses for medical care and treatment.
The plaintiffs allege the defendant's delivery driver was texting while driving, failed to timely apply his brakes, failed to maintain proper control of the vehicle and followed another vehicle too closely.
The Phelans seek trial by jury, judgment for damages, pre- and post-judgment interest costs of court and all other relief. They are represented by attorneys Benton G. Ross and Douglas C. Monsour of The Monsour Law Firm in Longview.
