Consultant alleges oilfield services company failed to pay overtime

GALVESTON — A Louisiana man is suing a Houston oilfield services company, alleging violation of workers compensation acts in failing to pay proper overtime.

Mickey Peck of Caddo Parish, Louisiana, filed a class action complaint, individually and on behalf of all others similarly situated, Sept. 26 in the Galveston Division of the Southern District of Texas against Green’s Energy Group LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Peck worked for Green's Energy Group from approximately October 2012 to February 2015, and regularly worked more than 40 hours in a week but was paid on a day rate basis only.

The plaintiff alleges the defendant mis-classified him as independent contractor and deliberately failed to compensate him for his overtime hours at the rate of time and one-half his hourly rate as required by FLSA.

Peck seeks trial by jury, an award for all unpaid wages, liquidated damages, court costs and attorney fees and all other relief.
