MARSHALL — A car salesman is suing a Longview Toyota dealer, alleging disability discrimination and wrongful or constructive eviction.
Jimmy Lancaster filed a lawsuit Sept. 28 in the Marshall Division of the Eastern District of Texas against Longview Toyota Operations LLC and Pat Lobb's Toyota of Longview, alleging failure to provide reasonable accommodations.
According to the complaint, due to Lancaster's colon cancer, which left him without his colon and rectum, he has to take sudden and frequent breaks to relieve himself and empty his colostomy bag. The suit says the previous owner allowed Lancaster to do so but not the defendants.
The plaintiff alleges the defendants have failed and refused to make any reasonable accommodations, treated Lancaster differently from other employees and terminated his employment in February 2014.
Lancaster seeks trial by jury, actual damages, punitive damages, pre- and post-judgment interest, attorney fees, costs of suit and all other appropriate relief. He is represented by attorney Jonathan Wharton of The Law Office of Jonathan Wharton in Longview.
