BEAUMONT — A Jefferson County woman is suing health care providers, alleging their negligence caused her husband's death.

Margaret Lichwardt, individually and as independent executor of the estate of Ulrich Lichwardt and for and on behalf of any wrongful death beneficiaries, filed a lawsuit Sept. 29 in Jefferson County District Court against National HME Inc., New Century Hospice Inc. Acadian Ambulance Service Inc., Catalina Cylinders Inc., et al, alleging failure to design the oxygen tanks and regulator used by her husband so that proper airflow would be maintained.

According to the complaint, on Sept. 30, 2014, Ulrich Lichwardt was discharged from the Medical Center of Southeast Texas. Upon his arrival at home, however, the suit says he did not receive oxygen on time and died.

The plaintiff alleges the defendants defectively designed and manufactured the oxygen tanks and regulator so as to render them dangerous to Ulrich Lichwardt and failed to provide adequate warnings and instructions about the tanks.

Margaret Lichwardt seeks trial by jury, monetary relief of more than $1 million, post-judgment interest, costs of suit and all other relief. She is represented by attorneys Brian D. Sutton of Sutton & Jacobs LLP in Beaumont, and by J. Scott Frederick of Law Office of J. Scott Frederick PLLC in Beaumont.
