Chick-Fil-A operator accused of unsafe conditions that led to a fall

HOUSTON — A business invitee is suing Joseph Decola d/b/a Chick-Fil-A, a property operator, citing alleged insufficient measures were taken to prevent injuries.

Josefina Mayorga filed a complaint on Oct. 7, in the Harris County District Court against Joseph Decola d/b/a Chick-Fil-A alleging that the property operator failed to exercise ordinary care to protect her from being injured.

According to the complaint, the plaintiff alleges that, on Oct. 8, 2014, she was severely injured when she stepped on a substance covering the floor on defendant's property and hit a table. Her injuries required extensive therapy and rehabilitation. The plaintiff holds Joseph Decola d/b/a Chick-Fil-A responsible because the defendant allegedly failed to properly maintain the safety of the floor, negligently allowed and failed to correct the dangerous condition and failed to warn her of the existence of such dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in an amount within the jurisdictional limits of the court, pre- and post-judgment interest, costs of court and such other and further relief.
