Pro Drive Outboard accused of selling a defective motor boat that led to an accident

MARSHALL — Three motor boat riders are suing Pro Drive Outboard LLC, a manufacturer, citing alleged insufficient measures were taken to prevent injuries and negligence.

Clay Powell, Jason Moore and Jose Sanchez filed a complaint on Oct. 11, in the Marshall Division of the Eastern District of Texas against Pro Drive Outboard LLC alleging that the manufacturer negligently manufactured the motor of the aluminum boat.

According to the complaint, the plaintiffs allege that, in Feb. 11, 2015, Clay Powell, Jason Moore and Jose Sanchez were riding a 2012 Pro Drive aluminum boat with a 2012 Pro Drive outboard mud motor when suddenly and without warning and for the second time, the boat abruptly and sharply made a left turn and rammed into a tree, causing plaintiffs to be violently thrown from the boat. All three suffered serious injuries to their bodies. The plaintiffs holds Pro Drive Outboard LLC responsible because the defendant allegedly negligently designed, manufactured, marketed, assembled and tested the defective motor boat and failed to warn users that the motor's relocating pin can become disengaged during operation.

The plaintiffs request a trial by jury and seek judgment against defendant for all damages, pre- and post-judgment interest, costs of court and such other and further relief. They are represented by Bruce A. Smith and T. John Ward, Jr. of Ward, Smith & Hill PLLC in Longview.
