Henderson County motorists blame hauling company for crash

TYLER — Two Henderson County motorists are suing a hauling company, alleging its negligence led to a crash that injured the plaintiffs. 

Carla Lockhart Stroud and Roy Lee Stroud of Chandler, Texas, filed a lawsuit Oct. 13, in the Tyler Division of the Eastern District of Texas against Contractors Cargo Co., Inc. alleging the hauling company negligently entrusted its vehicle to an employee.

According to the complaint, on June 18, Carla Lockhart Stroud and Roy Lee Stroud were travelling southbound and stopped at a red traffic light on state Highway 69 at its intersection with county Road 492 in Tyler. The suit says they were violently struck by a vehicle owned by Contractors Cargo and operated by its employee, Lee Allen Gruver Jr. 

The lawsuit states the Strouds were seriously injured, resulting in pain and suffering, mental anguish, loss of earning capacity and medical expenses. The plaintiffs allege Contractors Cargo negligently hired, trained and supervised its employee, and Gruver failed to keep a proper lookout and failed to maintain proper control of the vehicle.

The Strouds seek trial by jury, judgment in excess of the minimum jurisdictional limits of the court, pre- and post-judgment interest, and all other relief to which they are entitled.
