GALVESTON — Two Sugar Land homeowners are suing contractors and subcontractors, alleging failure to properly complete a home repair project and breach of contract.

Richard Schwarz and Glenda Schwarz filed a lawsuit Oct. 14 in Galveston County District Court against Gulf Coast Custom Homes Inc., Affordable Air & Heat LLC, Brent Ballard, EnergyGuard Foam Insulators LP and Premier Technologies LP, alleging failure to comply with the Galveston building code requirements.

According to the complaint, the Schwartzes suffered damages to the interior of their home, costs arising from the labor, services, materials and expenses associated with repairs done to their home, including the heat and air conditioning system, and expenses of temporary housing during the repair period.

The plaintiffs allege the defendants failed to perform work in a good and workmanlike manner and failed to cure the defective work.

The Schwartzes seek a trial by jury, judgment for all damages, attorney fees, pre- and post-judgment interest, costs of court and all other relief to which they are justly entitled. They are represented by attorney Barry S. Rabon of Coats Rose in Houston.
