ARSTRAT accused of calling wrong number in attempt to collect debt

HOUSTON – A Nevada man alleges a Houston company is calling him in an attempt to collect a debt belonging to another person.

Stephen Swinton filed a complaint on Oct. 14 in the Houston Division of the Southern District of Texas against Patient Accounting Service Center LLC, doing business as ARSTRAT, alleging that the collection agency violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that he continues to receive calls from the defendant in an attempt to collect an alleged debt owed by someone else. The plaintiff holds Patient Accounting Service Center LLC responsible because the defendant allegedly engaged in a conduct to harass, oppress, and or abuse him in connection with collection of the debt. As a result of defendant’s acts and practices, he claims he has suffered and continues to suffer humiliation, anxiety, emotional distress, frustration and embarrassment.

The plaintiff requests a trial by jury and seeks award for actual, statutory, and punitive damages, costs of litigation and attorney’s fees and such other relief as may be just. He is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
